Common Space Law
of
Governance and Responsibility
(Working title)
Preamble:
“Space law is the body of law governing space-related activities, encompassing both international and domestic agreements, rules, and principles. Parameters of space law include space exploration, liability for damage, weapons use, rescue efforts, environmental preservation, information sharing, new technologies, and ethics. Other fields of law, such as administrative law, intellectual property law, arms control law, insurance law, environmental law, criminal law, and commercial law, are also integrated within space law.”
Because space exploration requires crossing transnational boundaries, space law has become a field independent from traditional aerospace law. Numerous national space agencies and other organizations such as the United Nations Committee on the Peaceful Uses of Outer Space (COPUOS) have debated issues of international space law and policy for many years.
One clear message is that to avoid nationalistic conflicts in space and on other celestial bodies there is a need for one single entity to have the authority to write binding laws applicable to all players operating off planet.
Scope and Objectives:
The goal is the creation of a single set of space laws written by and accepted by the global space law community and other participants. (independent of nationalistic or business influences). Such laws would circumvent certain players at the U.N. who have veto powers over resolutions and treaties.
The laws written here are those space laws that are applied to all regions of space acting as an applied "Common Space Law of Governance and Responsibility". The purpose of these laws is to provide a common base set of laws to which all space faring nations, businesses and individuals or organizations are held accountable by the space community. Acceptance of these laws will be more beneficial and practical than independent attempts to manage or govern space activities.

This page is an index of all submissions beginning with the ones I have entered. This is an "index" of topics you and others feel should be included as part of space law. This is how we begin to develop a consensus on what space law should encompass.
Your submissions will be indexed by applicable region then alphabetically within each category
Index of recommended laws are listed by region # then in alphabetical order in the following format:

Regional Space
Applying Regional Designations to Space Law
To be effective, space law needs to apply to a well defined "location" the same as aviation or marine law does. With that in mind I have defined 4 basic regions within space based on accepted scientific and legal terminology. These 4 regions and the reasons for them have been explained further HERE
Region 1 - National Air Sovereignty Law
Article 1 of the Convention on International Civil Aviation, with regards to sovereignty of Airspace states that 'every State has complete and exclusive sovereignty over the airspace above its territory
Region 2 - Orbital Sovereignty Space Law
I have defined this region as being that space reaching from the planets surface to 10,000,000 KM beyond the apogee of the planets furthest moon or debris ring such as Saturn has.
Region 3 - Inter-Planet and IPF Space Law
For the purposes of this site I am defining Inter-Planet space as being the space within the solar system that is between the Orbital Sovereign Boundaries of each planet. This also includes interplanetary flight law as part of this region.
Region 4 - Galactic and Interstellar Space Law
Scientists define the beginning of interstellar space as the place where the Sun’s constant flow of material and magnetic field stop affecting its surroundings. This line is called the Heliopause.
If you believe there should be additional regions defined please submit them using the "Submit Updates" panel. They will be posted to this page.
Please submit the update indicating Region # - Name of region

There is still much to be written in the way of space laws. The more important point to note though is that the international / interplanetary regulatory body of space law and space activities and development needs to be independent of nationalistic or business influences to ensure equitable access to space. The U.N. does not have this luxury as long as certain players have veto rights.
I have addressed such issues and many more in my main blog on interplanetary colonialism that includes posts on Science and Concepts on Interplanetary Flight and Colonialism, from Governance and Administration to Security, Finance and Rocket Platforms
During my research into the many topics in that blog I became aware that there does not seem to be a single agency whose responsibility it is to develop or coordinate space law . I came across numerous sites writing about such laws in one form or another and other than the U.N. treaties, there is no consensus or managing body.
The U.N. Committee on the Peaceful Uses of Outer Space (COPUOS) and the United Nations Office for Outer Space Affairs (UNOOSA) do not have a direct roll in the development of space laws. Their stated purposes seem to be in the capacity as a muse more than a development body.
It would be advantages if the people looking at writing space law or developing the concepts of space law were all able to coordinate their efforts through a central location or agency. Before that can happen though, there needs to be a consensus on what to include.
With that in mind this site is intended to do just that.
How to Participate
This site has very few pages. Each page has been designed as a list or index of topics, categories or updates which have been submitted by space law lawyers, persons involved in writing space law or general topic specialists. To provide an update simply make a submission using the "submit update" panel on the left. Your submission will be added to the appropriate page in the appropriate location.
There are also 4 other pages where you can provide:
Links - to your space law site or organization
P&P - links to your publications and posts.
Law - The actual Space law document(s)
Video - Videos discussing space law which you created or were a participant in
These reference links are provided as background materials to help achieve the goal of the creation of a single set of space laws written by and accepted by the global space law participants. Those laws could begin to be written as soon as we have enough legal participants to pen such laws.
I ask that each participant provide an online ID (such as your twitter ID) at the end of your update so you may be contacted by other participants to discuss your thoughts or purpose on a particular submission. (This is not mandatory but there are obvious advantages)
The following format has been adopted to ensure that the index is updated correctly. Make your submissions as follows:
NEW REGION - To request inclusion of a new Region designation
Example: Region 5 - Transient - @jclulow1
Region # - Region Name - Your ID
CATEGORY - To submit an update to the alphabetic category listing:
